Who has the authority to sell

In New Jersey, estates are generally handled through the Surrogate's Court in the county where the person lived. If there's a will, the named executor receives Letters Testamentary. If there isn't, an administrator receives Letters of Administration. Those documents give the legal authority to sell the house on behalf of the estate.

Taxes and waivers

Depending on who inherits, New Jersey inheritance tax may apply, and a tax waiver is often needed before real estate can be transferred. Close relatives such as spouses, children, and grandchildren are generally exempt from the tax itself, but the paperwork still matters. An estate attorney can confirm what applies to you.
